Penalties on Your Driver's License

Texas laws provide strict penalties against individuals who have failed a breathalyzer test or have refused to submit to a breath test. In addition to facing criminal DWI/DUI charges, individuals who fail or refuse a breathalyzer test will automatically have their license suspended/revoked:

  • Breath test failure: First offense DWI (in 10 years) will result in the individual's license being revoked for 90 days. Second or subsequent offense (in 10 years) will result in license suspension for 1 year.
  • Breath test refusal: First offense refusal (in 10 years) will result in license suspension for 180 days. Second or subsequent offense will result in the license being revoked for 2 years.

Challenge License Suspension/Revocation

You have a right to challenge the suspension of your driver's license. However, you must move quickly to take advantage of this right. Your driving privileges are not handled during criminal proceedings involving your DWI arrest. In fact, your license will be automatically suspended unless you request a hearing within 15 days of your arrest. This hearing is called an administrative license revocation (ALR) proceeding.

Our drunk driving defense attorneys have the experience, skill and determination to provide clients with a vigorous defense at the administrative license revocation proceeding. We aggressively challenge the probable cause for the arrest and all other procedural matters surrounding the arrest.

Protect Your Rights. Preserve Your Driving Privileges.

In today's society, driving is an essential privilege that enables you to get to work, doctors' appointments, schools and many other necessary locations. It can be nearly impossible to function without your driving privileges. Protect yourself against a suspended or revoked license. Contact our drunk driving defense lawyers for a free initial consultation and thorough case evaluation.
