Penalties on Your Driver's License

Texas laws provide strict penalties against individuals who have failed a breathalyzer test or have refused to submit to a breath test. In addition to facing criminal DWI/DUI charges, individuals who fail or refuse a breathalyzer test will automatically have their license suspended/revoked:

  • Breath test failure: First offense DWI (in 10 years) will result in the individual's license being revoked for 90 days. Second or subsequent offense (in 10 years) will result in license suspension for 1 year.
  • Breath test refusal: First offense refusal (in 10 years) will result in license suspension for 180 days. Second or subsequent offense will result in the license being revoked for 2 years.

Challenge License Suspension/Revocation

You have a right to challenge the suspension of your driver's license. However, you must move quickly to take advantage of this right. Your driving privileges are not handled during criminal proceedings involving your DWI arrest. In fact, your license will be automatically suspended unless you request a hearing within 15 days of your arrest. This hearing is called an administrative license revocation (ALR) proceeding.
